Terms of Service
Acreage Technologies LLP has a responsibility to protect each and every client and to provide the best possible services available. The following guidelines were designed to ensure these obligations are met. Please read through this page and make sure that you understand, and agree with, all points listed. Also, if you are a current client of Acreage Technologies LLP (by continuing to pay your monthly fee) it is your responsibility to check back to this page every 30 days and check for any important or relevant updates.
When a client signs up for our services, or continues to pay your automated monthly renewal fees, you agree to be bound by, and to comply with this agreement. Paying your monthly fees, or completing the sign up process for a new account constitutes an agreement, just as if you had signed it and is the legal equivalent of your signature on a written contract.
Scope of Services
All services provided by Acreage Technologies LLP may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any is prohibited. This includes, but is not limited to: copyrighted material, the material we judge to be threatening or obscene or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Acreage Technologies LLP from any claims resulting from the use of the service that damages the subscriber or any other party. Acreage Technologies LLP will be the sole arbiter in determining violations of this provision. Also prohibited are sites that promote any illegal activity or present content that may be damaging to Acreage Technologies LLP. These terms and conditions are governed by and to be interpreted in accordance with laws of India, without regard to the choice or conflicts of law provisions of any jurisdiction. You agree, in the event of any dispute arising in relation to these terms and conditions or any dispute arising in relation to the web site whether in contract or tort or otherwise, to submit to the jurisdiction of the courts located at Jaipur, Rajasthan, India for the resolution of all such disputes.
All clients must be 18 years of age to obtain any level of service from Acreage Technologies LLP.
At no time will any of a client’s sensitive data be given, made public, or used in any manner other then what is intended or is necessary for Acreage Technologies LLP to do their job. Please rest assured that all of your sensitive data is safely protected and in good hands when you use our services. We do not share our customers’ information with any third parties for any reasons.
Customer understands and agrees that occasional temporary interruptions of Internet Services may occur and agrees that under no circumstances will Acreage Technologies LLP be held liable for any financial or other damages due to such interruptions. In no event shall Acreage Technologies LLP be liable to the customer, or any other person, for any special, incidental, consequential or punitive damages of any kind, including, without limitation, refunds of fees, loss of profits, loss of income or cost of replacement services. Acreage Technologies LLP shall not be held responsible for any claimed damages, including incidental, and consequential damages, which may arise from Acreage Technologies LLP ‘s servers going off-line or being unavailable for any reason whatsoever. Furthermore, Acreage Technologies LLP is not responsible for any claimed damages, of any sort, including incidental or consequential damages, resulting from the deletion or corruption of any necessary system files.
The customer explicitly agrees to make daily or weekly backups of all sensitive and important data. This data includes, but is not limited to: any and all client data, any and all hosting account data, any and all server configuration data, and any other data that the customer deems important to daily operations of their company and or servers. These backups are meant to provide a solid restore point in the event of an emergency or mistake. If a mistake or emergency did occur, then the customer would have a recent backup of all missing, corrupted, or modified files necessary to correct the emergency situation at hand. Acreage Technologies LLP would then have everything necessary to correct the matter without serious data, financial, or uptime loss. The backups are to be used as a tool to minimize and safeguard against any serious loss for the customer, thereby helping both Acreage Technologies LLP and the customer listed in this document with fulfilling their contractual obligations. Full backups of all systems must be in place prior to the Sysadmin starting and are the sole responsibility of the customer to maintain.
The client agrees that Acreage Technologies LLP ‘s total maximum liability, with respect to any of our services provided under this agreement, and breach of this agreement, is solely limited to the remaining amount of prepaid services. Acreage Technologies LLP ‘s owners, Directors, managers, System Administrators, Developers, and contractors shall not, under any circumstance, be liable for any direct, indirect, incidental or consequential damages resulting from the use or inability to use any of the services the client has signed up for or has agreed to allow us access to. The client also understands that no refunds will ever be granted for more than 1 month’s total service fee, as this is the maximum amount allowable for any refund unless the prepaid term was longer then 1 month. (ie: 12 month prepayment of service). For all disputes with regard to our services the jurisdiction shall be the court situated in Kochi, Kerala, India.
All Monthly Server Management and Webhosting Support services require one month per-payment in full. This includes setup fees, hourly fees, one-time fees, and all monthly fees. Clients are expected to remit payment prior to their monthly billing cycle renewal date. We will invoice all clients 7 days in advance to allow ample time to make payment. If payment is not made within the 7 days provided, and the billing date has arrived, then their account will be immediately suspended and all services stopped. The client then has 48 hours to pay their account in full before the account is deleted from our monitoring system, our billing system, our help desk, and all other services supplied by Acreage Technologies LLP.
You may cancel your Acreage Technologies LLP service only by submitting a cancellation request from your client area at http://www.ideaminetech.com. Charges for canceling services are not prorated at all if your service is renewed on a monthly basis. All cancellation requests should be received at least 30 days prior to the last date you plan to avail Acreage Technologies LLP’s services. All Acreage Technologies LLP accounts must be paid in full before the cancellation will be considered complete. You agree to the auto-renewal of your account as long as you have not filled in the form listed above. This means that your account will continue to be paid for on a monthly basis until you have received a confirmation of service termination from https//acreage.tech website.
All client billing cycles are based on the day that you signed up for service initially. The client will receive an invoice every month 7 days prior to when their account becomes due. The full amount due will be paid within that 7 days of this monthly invoice or service will be suspended or terminated. Payments made after the due date will attract a late fee of $50. For clients who pay for a ‘per ticket’ service, the invoice must be paid within 24 hours or all services will be suspended immediately.
The client agrees never to contact any of Acreage Technologies LLP ‘s managers, administrators, developers, or contractors for any position outside of their current employment with Acreage Technologies LLP. If a client breaks this term, either before, during, or after their contract with Acreage Technologies LLP, the client explicitly agrees to allow Acreage Technologies LLP to charge the client’s credit card in the amount of $5000. This term is nonnegotiable and is grounds for immediate termination of the service contract between the client and Acreage Technologies LLP.
Refusal of Service
Acreage Technologies LLP reserves the right to refuse, cancel, or suspend service at their sole discretion. All sub-networks, distributive clients of Acreage Technologies LLP must adhere to the above policies. Failure to follow any term or condition will be grounds for immediate account deactivation. Acreage Technologies LLP reserves the right to deny the refund of any money paid thus far if these policies are broken.
Modification of Agreement
Acreage Technologies LLP reserves the right to add, modify, and delete any provision of this Terms of Service agreement at any time without notice. It is the sole responsibility if the client to visit this url once every 30 days to look for updates in the agreement.
